There is already a provision in the Transportation Code that allows “Pass Through Tolls”. The idea is for local government to share in the revenue generated by a toll road supposedly to benefit local property tax payers. Not necessarily a bad idea, but HB 3722 attempts to change the process slightly to designate the local share of what the bill calls “Pass Through Financing” be spent on land development in a Transportation Reinvestment Zone (TRZ) which happens to be the land along the toll road.
Local Government will be offered a share in toll income only if they spend the money on land development along the toll road, and obviously, they have to approve having a toll road before they can get money to develop land along a toll road. Of course the fund will be controlled by TxDOT.
Bottom line is since the idea of private companies owning and operating toll roads in Texas has met with quite a , the companies looking to cash in on Texas toll roads have decided to give a cut of the estimated $600 BILLION in income to Texas governmental entities.
Or at least that’s what it looks like to me.
